My ex is on my sons birth certificat as father, but he is not. (he is aware of this) How do I go about having his name taken off? Real dad doesn't acknowledge. Don't know if I should mess with him or not. Actions to be taken in either case????????

You don't say how old your child is or what state you are in.

You would probably have to file a petition in Family Court for a hearing on paternity. Once the test is done, a new birth certificate would be issued with father unknown, unless you want to bring the biological father in also for testing and have his name put on the certificate. This would also entitle you to child support from this man.

No so fast there.. it is much more complicated than that. If they were married at the time of the birth and the child is at least 2 years old then that changes things.

Also, you have to consider other things.. what involvement does the current 'father' have and what sort of mess will a petition to the real father make.
