I LIVE IN ILLINIOS.JUST RECIEVED A MOTION TO MODIFY CHILD SUPPORT.EX WANTS REDUCTION.
ILL.SUPPORT STANDARD IS 25% OF NET FOR 2 KIDS.HIS NET IS LOWER THAN IT WAS WHEN SUPPORT WAS ORDERED,BUT ONLY BECAUSE IRS CAUGHT HIM LYING ABOUT INCOME AND ARE NOW TAKING MORE TAXES.(CHILD SUPPORT WAS ALSO BASED ON THE FALSIFIED AMT.)ARE THERE GUIDELINES FOR THIS TYPE OF SITUATION?
ALSO, CHILD SUPPORT IS SET ON A YEARLY AVE.(HES A CONSTRUCTION WORKER WITH A WINTER LAY OFF)BUT EVERY TIME HE GETS LAID OFF,THE JUDGE ORDERS SUPPORT TO BE REDUCED.IF THIS IS ALLOWED IN THE WINTER , SHOULDNT IT BE RAISED IN ACCORDANCE WITH HIS INCOME OVER THE SUMMER?
THIS MAN IS 6,500 IN ARREARS AND ALL THEY EVER DO IS TAKE HIS DRIVERS LISCENCE.(HE DOESN'T CARE,DRIVES ANYWAY)HES NEVER OBTAINED INS. FOR THE KIDS AS ORDERED 3 YRS AGO -NEVER PUNISHED.WHAT CAN I EXPECT FROM THIS EXT HEARING?

Document everything and present your case to the judge as you have done here. Normally, a judge will not lower the amount just because the IRS are taking more money due to his lies.
