I am married to u.s.citizen in march 1999....

she filed my petition in dec.1999 and now we have some troubles if she serves divorce papers to me ....will INS giveme nonimmigrant visa for divorce contest i would prefer to be physically present while contest instead working it out through an us attourney...
we have given her gifts which were very valuable for us and costly even..i would like to receive them back and we hve no children involved here....

let me know what will be the consequenses??/

You have posted the same question on this board, the criminal board, the immigration board. Why? We know you have language barrier BUT NOW WE KNOW WHY YOUR WIFE DIVORCED YOU. Take the advice USdeeper gave you, Legal Beagle gave you and everyone else on every board. Get a grip with your life, ask your parents for advice and quit asking the same question over and over and over and over and over and over and over. You wife is going to divorce you, you will more than likely have problems with INS because you are trying to think of a way to get into this country and it isn't flying with this crowd ok.

It does not matter how many times you ask this question, the answer is still the same. I wish there was someone else who was an 'expert' in this field to give you a 2nd opinion as you obviously do not like my answer.

Since you have already married and because your wife has already notified the INS of the marriage, then you have next to no chance of being allowed entry to the US. What confuses me is that on the immigration board you are asking if you can get a green card on entry or would it be a conditional PR status (should you both decide the marriage is working).. this leads me to presume that the reason you want entry into the US is so you can stay, regardless of marriage.

An attorney can easily represent you in a divorce and if you try to do it on your own, then you will get screwed. An attorney can also see that the return of those items are in the divorce petition and charge her with contempt if she fails to return them.

So basically, no, you can not enter the US to contest a divorce. It was no last week and it will be no next week. The INS know about you and if you try to enter without an approved I-130 you will be packed in the next cargo ship and will not see light again for 6 months when it docks in Mongolia.

Since I am the resident expert on immigration matters at this site, then I am afriad you will have to go elsewhere for another answer. Your other option is to call a US based immigation attorney or the US Embassy in Indian.
