divorced 10 yrs ago in california, simple divorce, no children, no property to speak of. divorce bill over $10,000 due to continuances and legal red tape. paid $7,000, rcvd nothing not even my clothes, but didnt pay the balance due to stubborness and anger. debt elevated to over $7,000 with interest,original attorney settled in writing last year for $3,500 (1/2 the remaining billed amount), however, prior to payoff of settlement found out that he had sold debt to another collection and they want $12,000. they are not willing to settle on a reasonable payoff. 1. Can the original debtor make a written settlement on a debt that he sold? 2. If so, is he bound to it? 3. Possible state bar violations? 3. 4. What process, if any, can i take to make the written settlement stand with the original debtor, or have the divorce bill reviewed by judge. 5. can i file paperwork to go before a judge? If so, then what kind?
Would like to settle for a reasonable amount and get on with life, or at least go back before a judge and have the $10,000 cost reviewed. please help. willing to pay if attorney can help.
