| Arkansas: Filed for divorce, wife states not sure if child is husbands. Man request DNA testing via lawyer, woman does not comply. Court order is issued for test to be done. Woman does not show for testing. Lawyer submits a draft for motion of contempt of court. What happens if woman does not show for test and what legal rights does the man have? Has anyone heard of a motion for dismissal with prejudice? |

[/b]

A dismissal with prejudice means the case is concluded and can never be refiled. Not sure how that can be the case here since the court would want to know who the legal father is... and she can only stall things so long. |
