Question

My ex husband had 5% stock in a company, he said the value was $29,000, He knew the company was being sold pushed for a quick divorce. I asked if it was for sale he said no. Now I hear he received close to a million dollars. He lied. Can I now go back to ask for more? My divorce was final 7/98 Please help.

You have the right to appeal any decision as many time as you want. But if the judge feels the appeal is frivilous you could be fined and or jailed.

Under the circumstances that he lied.....well I'd appeal it. You never Know how a judge will decide and its worth it if you get part of that cash.

He probably thought you would never find out the actual value of the stock and he would be home free. First you have to prove he lied and the amount the stock was sold for. Your attorney can petition the courts to order him to provide the info on the stock.

My response:

All you have to do is ask your former attorney. If your facts are exactly as you've stated them here, he / she will tell you the same thing I've told you. If you were to appeal the issue now, when you had a chance to have the business evaluated then, but failed to do so, your appeal would be frivolous and dismissed. I don't believe you have any appealable grounds.
