I am currently living in spain. My spanish national girlfriend wishes to divorce her husband; whom she has been seperated from for 5 years now. Her husband is in the states. Can she divorce him from here in spain, without having to go back to the states. She was married here in spain. She has a green card and passport and all necessary paperwork for living in the U.S. Can a stateside lawyer divorce her, without her being present in the states?

It takes years for a divorce of this type in Spain. I know it can happen faster in the states

Has she ever lived in the US ?.. what state is her ex in ??..

A Spainish national, living in Spain who was married in Spain will not be able to file for divorce in the US.

Whether the husband can is another matter.

She has lived in Florida. Her ex is still in Florida. He has not been in contact with her in years, and has no intention of divorcing her, as far as she knows. A lawyer in Florida couldn't perform the divorce?

She has lived in Florida. Her ex is still in Florida. He has not been in contact with her in years, and has no intention of divorcing her, as far as she knows. A lawyer in Florida couldn't perform the divorce? Thank you for the information!

Sorry.. but you need to have been a Florida resident for at least 6 months before you can file for divorce.

She lived in Florida for about 1 year. What other requirements does she need to meet; to either be considered a resident and/or to get a divorce in Florida?

At the time of filing the divorce, she needs to have been in FL for the last 6 months.. she needs to have a residence and a FL drivers licence helps.

Is the, "being a resident for the last 6 months" rule pretty much standard in all states to file for divorce in that state?
She has Florida drivers license, but has not been a resident in the last 6 months. So, my only option in getting her divorced in the states; is to move her back to the states.
