What are the legal implications for married man to leave pregnant spouse. Can he go ahead and file for divorce while she is pregnant or does he have to wait until she delivers?

He can file. You can file as well. You could go to trial and decide within the cooling off period to get back together as well. Not knowing "the rest of the story", one could assume that he is going to assert that the baby is not his. If so, he will probably seek tests to prove it's not his as well.
You on the other hand have issues as well. Who holds the insurance? Each state is somewhat different, but you will probably have to legally pursue the matter to insure that you and baby are covered, should complications arise.
Can you give any more info as to why he is wanting to leave ?

The baby is ours together. We work at the same place and the insurance is under both our names. I am assuming he will have to carry the insurance as he does on his other 2 children. He is leaving to go back to his first wife.

He is leaving to go back to his first wife. If he leaves during pregnancy, will this affect the outcome of custody of the new baby, visitation rights, child support? Will this hurt him as far as the baby goes when we go to court or will it not affect him at all?
