My husband's ex has physical custody of their 14 year old son. They went to court 2 years ago because the son wanted to live with his dad--the son was 12 at the time. Because the child was still in middle school, the judge decided in favor of keeping the child with his mother as to not disrupt his schooling. At that time, the child was 12 and going into 7th grade. Now, 2 years later, the child is 14 and will be beginning high school. He continues to state that he would like to move here with us (the ex lives in a different city but same state about 1 1/2 hours away). When my husband talked to his ex about changing physical custody she replied that "maybe next year." This does not make sense to us as he will be starting high school THIS year and it will probably be harder for him next year to change schools. My husband and I really cannot afford to fight in court again with an attorney but we would like to have the child move here with us BEFORE school starts. The child said that he just won't go back to his mother's house and that he wants to start football practice here, etc. Do we need to have an attorney to go back to modify physical custody or is there some way we can just go to court and represent ourselves? We spent a lot of money the last time and know that we cannot do it again. Please help!!!!! |
