My brother was recently unjustly accused of domestic violence. His wife wants to move out of state with her Mom and have full custody of their 2 year old son. They had decided their marriage was over and had been discussing legal separation and child custody. One evening after an argument she made up a story stating he punched her twice. She said the 2nd punch was while she was holding the baby and that the baby got hurt as a result. She then called the police and had him arrested. She actually is the abuser. She has hit him, she has thrown several things at him. She has destroyed their furniture, but it is my brother that looks like the offender. Now she states she will have full custody and move out of state and not allow him to see the baby. She knows thats what would hurt him the most. He is a very good and loving father, and fervently denies ever hitting her! On several occasions, he has had to leave the house to avoid further abuse from her. He would like to have shared custody. What can he do?
