HELP !!!! My ex husband has our children for their two week summer vacation . I have told the children the dangers of drinking & driving (they are 11 & 9 ) and asked them to call me if he ever put them in a dangerous situation. I know that's hard for them but I am worried about their saftey.Well, someone seen them out in a boat,with their dad & his wife drinking !!! I know he takes medication that he should not drink with besides that HE SHOUD NOT DRINK AROUND MY KIDS!!!! What can I do ??? I have already asked him to not do it in front of the kids and i can't put all the weight on the kids.they shoudn't have to worry about that. PLEASE HELP!!!

My response:

It's unfortunate, but unless he's "pulled over" for drinking and driving, or drinking while boating, there's not much you can do. In order to file for an Order to Show Cause, or for a Temporary Restraining Order, you need the requisite, first hand, proof. Mere hearsay is not enough. You need witnesses who can testify that they saw and/or smelled him drinking alcohol to the point of intoxication or impairment while driving.

Without such proof, there's not much you can do.
