My home state is Indiana. My daughter will be 18 on 10/1/00. In August she started college only to drop out after six weeks. She is back at home with my ex-wife. My question is am I still oblicated to pay child support since she is out of school, and is emancipation an automatic thing or is it something that need a court order. Also, my daughter says she "may" go back to school next year.

You have to prove in court that she is Emancipated, and prove that she dropped ou tof College.

And exactly how do I prove that she is emancipated and that she has dropped out of college. I am not the custodial parent and I have no records from her school

It appears to me that my fastest and easiest solution to to have an attorney do all of this for me.

To find out if your daughter is Emancipated, you can check court records. You can only go to court and be Emancipated, if you under the age of 18. If you are still paying CS, then you need to file a modification to get it in front of a judge then you can question youe ex about the alledged emancipation, and drop out.

You have Parental Rights to have access to her school records, and almost anything else for that matter.

And you should get an attorney, also you might want to look into some of this and see what you find and collaborate with your attorney on his findings.
