drug screens in custody cases?

my husband and i are going to court for full custody of his son. the boy's mother has broke every rule on the current order.the big problem is drugs. she has been in rehab a few times and is currently still using.(we have seen her intoxicated) is there a law or any way that we can get drug screened? it seems if drugs are one of the major problems, the judge would order a screen. our lawyer wanted all parties to see a psychologist. her lawyer refused. we are currently waiting for a date for mediation and are not looking at a court date untill october.does anyone have any words of wisdom?? we live in texas . thanks !!

If she has physical unsupervised access to the child then forget mediation and get into court now. You can not hand over a child to someone you know to be on drugs.

If she does not have access to the child or it is supervised, why are you going into mediation ? What are you hoping to achieve? Does she intend to fight the custody request?

yea - it really should be that easy.but it is not. the court ordered split custody the first time (week to week)because of all the evidence & witnesses of drug use . her mom takes care of the boy. before we served her she would drop him off totally loaded - her mom would drive her- now, she just brings him to mom and does what she wants. this is not fair to a dad that has a good family with other children. yea- she is fighting. she says she wants full custody & support. she can't keep a job (got fired 3 times from the same job in 1 month), lives with mom(when she isn't staying with the boyfriend of the month)and says she has changed her life.bull#@#@# we know from using our computer,the drugs she uses only stay in your system for about seven days.our lawyer say if we can catch her loaded with the boy and call the cops would be best otherwise wait and bring out all the contempts of the order at once. you would think there would be a law to protect the child . we did not even know she was in rehab untill after she was out!!! her parents told us she was working nights . we knew something was up and video taped her never picking him up . we are so tired of the lies & problems!!! it should be so easy. thanks any words of wisdom help.
