My husbands ex has had a long history of drug problems. She kiddnaped his daughter for a year and then voluntarily returned. He has exclusive sole custody of his daughter and his ex finally appealed for visitation after 5 years. At the time of her appeal she was no longer using drugs, but we now susspect she is using again due to her appearence and irratic behaviour. Our attorney says we have to prove she is using. How do we prove? How can we leagally have her drug tested? The Judge was aware of her past drug abuse and simply told her not to do it again and that was it, shoulndt he had requested that she go under random testing consiering her past abuse and the kidnapping???? Help!!!! This child is very unstable emotionally and does not need a mother to have visitation who is unstable herself. What are our rights? If fathers can be subjected to drug testing why not the mothers???? Help

My response:
Take a video camera with you, and go through her garbage cans, looking for paraphenalia and other signs of drug usage. Talk to neighbors, go to where she hangs out, etc. It might be worth your while to hire a private investigator to do all this, and more, for you. Then you'll get a disinterested third party report to file with your papers.
