My 14 year old daughter refuses to visit her mother who has joint custody. Does she have the right to choose if she visits her mother or do I have to force her to go there? I live in Tennessee.

I don't know at what age a child in Tn. can make that determination, but it sounds like you should talk to a lawyer.

Unless your daughter is emancipated, or has court permission NOT to visit her mother, you are the one who will be held responsible for missed visits.

I strongly recommend that you find out why she doesn't want to go. If there are real grounds, then you will have to file for a change in visitation. Don't take this matter into your own hands.

Excellent advice IP..There is definitly a problem if your daughter does not want to see the Mother. Get to the root of the problem and then decide what to do next. You cannot withhold visitation at this time, so act on this quick. If there is indeed a problem that your daughter is in danger etc..You can withhold visitation and then go to court to modify the agreement. But only if your daughter is in danger. If she doesn't want to go there because she is strict and doesn't let her stay up all night, then there is nothing you can do. Get to the root of the problem, and go from there. Your X has rights to the child, and you cannot interfere with those rights unless there is REALLY something wrong. Good luck!
