Question
My son will be 16 in January, and I would like to emancipate him at that time. We live in Idaho. I am divorced from his biological father who is totally uninvolved and is probably in jail right now, or running to avoid the latest charges against him. What is the process involved? Do I have to appear before a judge, and does my son have to appear with me? Will the fact that my ex-husband still has visitation rights on paper prevent me from emancipating my son from me? Does my son have to show that he is or can be self-supporting (he has never even had a job of any kind) ? What other details should I know about?
