My husband was divorced 7 years ago in the state of Texas. There was no custody battle, my husband got his son and she got the girls. As of about 2 years ago we got custody of all the children and we have taken her to court for child support and now she wants custody of the girls back. My question is: She hired the same lawyer that my husband used to handle his divorce so is there anything we can do about this? Also we contacted this lawyer a few days back and discussed this custody case with him in the possiblities of rehiring him prior to her hiring him? (Is this a conflict of interest?)

Boy is it ever. Maybe he is unaware that you are one in the same person. Make sure this attorney is aware that he is representing someone against you, a former client.

thanks for the info billyjean! I was told by someone that i should what until the court hearing to tell them, that it would be to my advantage if i did that.If it is best to wait what do i need to say to the judge about this? Also i was wondering if it is a conflict of interest on the sole fact that we spoke with this lawyer a few days prior to the other party hiring him? (we told him very important information)
