| We've been divorced for 4 years, my ex immediately remarried (her 4th marriage) and although their relationship is unstable, our two children live with her. We live relatively close to each other in Massachusetts. Recently, she told me she's splitting with her current husband and wants to move to Texas (with her new BOYFRIEND) and she wants to take my children with her. I want to file for sole custody of my children but people are telling me, the mother has more rights than me. She's emotionally unstable and so is her boyfriend who is taking medication for schizophrenia. Do I have a chance? |

| You have a chance, but I can't tell how good without LOTS more info. Go hire a lawyer and file to modify custody. Mothers do not have more rights than fathers, all though some judges seem to think so. ------------------ This is not legal advice and you are not my client. | The first thing you do, (even without a lawyer) is to file a restraining order against her, preventing her from leaving the state until the courts hear the case. Go now. Next thing you do is hire a lawyer. There is 5 different things she has to prove to the courts. One of them being in the best interest of the children, how this will enhance THEIR lives.
