If parents living in Missouri have joint legal custody and the parent having physical custody is incarcerated for a criminal felony; auto theft, does physical custody automatically go to the non-custodial parent? Can anyone tell me where to research this?

It is not always automatic as the parent of the person who gets banged up is normally there on the spot so 'assumes' custody.

However, a quick visit to court can change things very easily providing the NCP has had regular contact and visitation with the child.
