My sister currently has full custody of her 2 young boys (6 & 4), the father gets visitation rights. The father wants the kids phycologically evaluated, inorder to get full custody. My sister was told she would have to pay the phycologist that the father chooses (baised towards father) and she should get her own phycologist(s) that she would have to pay for also. Is that true? Why should she have to pay for the fathers phycologist? She doesn't make much money, what if she can't afford the costs?

Thanks,
Concerned Brother

She does not have to pay squat unless a court orders her to. Also, in theory, he can not take them to be evaluated in this way if she has sole custody without her permission.

Personally I find it sickening to even think about taking that route. If she had money I would suggest petition the court to have him stopped from taking the child to be evaluated. If he wants to file for custody then do so on other merits and let the court order it if needs be.

Psst.. I am not an attorney, and even if I was, I would not tell you. What I am giving you is not legal advice in anyway. For proper legal advice, retain a person who openly admits they are an attorney.
