I am in Va. I have 18 mo old daughter. I have been separated since 3/2/00 out of household, but we had separate bedrooms for over a year. Met boyfriend in March 2000, spoke with 2 attorneys and ex and looked up laws, no problem it seemed with boyfriend moving in in June 2000.Oct. 26, '00 ex takes me to court for custody. No accusations of neglect, abuse or harm of any kind, and got temp custody. Since then daily he changes his mind based on his temper about my daughter. Visitation is just noted as "reasonable" to me with no contact with mother's paramour. Boyfriend moved out that day. My daughter got sick last Monday with strep and scarletina. Ex took her to daycare anyway. I had her all weekend. Ex and I had 3 hour talk Monday night (I still had her) where he agreed he would leave everything as it was before court (Joint, me with primary, he had visitation every Wed, and every weekend, never took me up on the Wed.)and that we would go to mediation. Tonight he demands her back (she is still sick, though mildly but enough to warrant keeping her home), and says we never had the talk Mon. He said since he is paying his sister 100.00 per week, she gets my daughter. I refused to let my daughter go. He says he is show causing me. What can happen to me in court? Can I file anything by way of an emergency hearing? Can I legally keep my daughter?

If there is a court order giving him custody then you have no choice but to send your child back. I am curious why you lost custody but presume it was due to living with your b/f. Document everything, have no unrecorded conversations and get an attorney if you do not have one for the actual custody hearing.
