Resently my finace's former girlfreind died in December. We found out in Febuary of the passing they have a daughter that is living in Missouri with her maternal grandmother. the grandmother is wanting to adopt her. He is objecting the adoption. How do we one get custody of her and prevent the grand mother from adopting her with out his consent.

You need to contact a lawyer or do research on the net what state are you in the same? As far as I know if he is on birth cirt. he has to be notified of the hearing and givin time to reply! what is stopping him from going and getting his child? if the mother passed away he can get the child you may want to file and order to show cause so the grandparents have to give the child back! he does want the child correct? how involved was he in the childs life before the childs mother passed away?

We live in Illinois the child lives in Missouri. She was born there and he didn't get to sign the birth certificate. He was taken to court and ordered to pay child support on the little girl he was declared teh leagel father of her. The grandmother has custody of her and is saying that she cant get any state help for her teh only way she can help her is if she adopts her. I don't know the law in Missouri but in Illinois she cant leagely adopt her with out his knowlege and him signing a paper. i look at it this way this little girl as already lost her mother there is no reason she should lose her father as well. the grandmother has told us that she woudl allow us to visit the child but she is adopting her. I don't knwo what rights she has or what rights he as so if someone could help I would be grateful.
