| I have full custody of my 2 children and joint legal custody. My ex has visits 2 times a month 1 overnight visit each time. I just recently went to court and was ordered to comply with certain requests<call the visitation center to begin exchanges, another mediation appt and another order>. The same day I went to court I immediately complied with all 3 things asked of me. Well, the next week my ex's lawyer sent me a letter saying I hadn't complied with one of the requests and therefore, she could file an ex-parte motion against me. She sent me notice of this on October 16 saying she wanted an answer by October 17 at 5pm or she would be able to begin filing ex-parte papers getting away with what ever she could! I didnt' recieve her letter until 5:30 PM on the 17th ..therfore unable to call her and let her know I had complied. I called the next day but she always has her secretary claim she is on the phone and doesn't know what I am talking about! I then called and faxed family court services with proof I complied and no one has yet to return my calls or reply by fax. What should I do? I haven't got a lawyer but my ex husband who owes 12,000.00 in arrrearge of child support has one. Any advice? |

| You should write a formal letter to your ex's lawyer detailing how you have complied with all three orders. Mail the letter to your ex, his lawyer, and keep a copy for the family court once they get back to you. |

| Thanks for the replys ... In answer to the question why don't I go after the 12,000 in arrearage? I have turned the case over to the DA of San Mateo County ... last May '99 when he owed a little over 6,000. Since then he racked up 6,000 more with NO consequences! I am at a loss for words. I call the DA and they say if he pays at least half we can't do anything and he does pay half ..it is due on the 1st of the month he pays on the 30th ..still no consequences... He puts his money in his sisters account but owns 2 luxury cars each worth $20,000. I am at a loss as to what to do .. The DA says they are doing the best they can ... but are they really? I just finished my 4 year degree in Radiology with his support being my SOLE income ..no welfare etc. He has tried everything to stop me from completing my education but I did it despite his attempts at economic submission. If you know how else I can get my arrears please help. Also, as for the advice on sending the compliance to the lawyer and the Family Court I did ..still with no response. I am going to write the judge personally ...anyone have words of advice on that? Thanks! |
