I want him out!!!

I have recently moved to Miami, FL at the end of May this year. My husband and I are both from Virginia, we were married there. We have been married since April,1999. We were seperated (not legally) in Sept., 1999. We had been on and off until I decided to move myself and my two children (1 of which is his)to Florida. At the last moment, he decided to move with us. After about a month, he left and moved back to VA. ( I was ecstatic) About a month later, he showed up at my door claiming he wanted to visit the children for that weekend. That was two months ago. He will not leave. Where do I go from here?? We have had a terrible marriage. He has been abusive in the past to the point of where I had to obtain a restraining order in February,2000 in VA. It was a huge mistake to ever let him back in, what do I do now??? The apartment where I live was rented for me by a family member (in their name) and I can't afford to abandon that home and ruin my family member's lease agreement. Please help.

Have you tried getting your family member that has the lease to have him removed from the premises? It would seem that he could be considered trespassing and all you would have to do is call the local Police Dept. or Sheriff Dept and have him removed. Then file for your seperation so he cannot come back into your lives.
