Your response to kimert was interesting, but... if in the case of a kidnapping, in which the ex- claims to the 'gaining jurisdiction that the child was abandoned, then has the child last name, or all for that matter, and posts in local papers, and the other parent knows nothing, the child is adopted away, the recourse is? Hardly ever a prison term if it's the mom, correct? Even in cases where one has primary custody, do visitation rights come into effect? are the non-cust. parents ever able to gain primary first? Since we don't know where the kids are, what is the GENERAL rule, as far as you can tell?
The questions can go on, and on, WHAT IF this, What if that, but... in a specific case, after gaining full custody, a previous non-cust. parent tried to recover the kids, and the ex- only needed to claim "FEAR", and the resulting ex-parte TRO kept the now Sole Cust. parent from taking the child home.
Won't go on, just the result of all this was that kids stayed with kidnapping parent, with a reverting to the previous order, and a (BS) promise by the ex- that contact would be kept. It's not, and right back in the same kettle. how can we make the water boil?
First we must convince the court that these are, in fact our kids, Years from now, we'll get, if anything, a phone call from one of the kids, and if they have an ability to decipher the BS, will know the truth, (?). Of Course, A 30.06 round was cheaper, as QUOTED by a wonderful attorney, and a JUDGE, recently retired from the bench.
