HI,

I really need your help right now.....

I was in arrears, until August 2000. The DA received 660.00 from me to pay off the arrears. At the same time I requested a complete pat history and breakdown of my account, which showed from both my accounting and theirs that I had in fact overpaid them. I received a credit for Sept. and only owed $31.81, I paid $32.00 and received a receipt from the DA. In Oct. I paid the balance ($212.81) also receiving a receipt.

Today, I received a "pay history" which states I owe an interest amount of $1.77. On the billing statement, It doesn't reflect these allegations. My account is CURRENT, no balance oweing. Can the DA try to collect interest from an un due balance? On the statement it says "ANY BALANCE IS SUBJECT TO AN INTEREST CHARGE OF 10% PER ANNUM." Doesn't this mean that ONLY when there is a balance that there is an interest charge???? Do I owe the interest if my account is current?

What can I tell her [case worker]to get her attention (Code quotes)? She has stated serveral times that the billing statements are incorrect and "run" a month late. Isn't this a false statement? Can I take them to court for erroneous charges?

Thank you so much!!

My response:
Ukiah, sweetheart, lovy-bear. You know I care about you, and you know that I want nothing but the best for you. You do know that, right?

Who knows, it could be an accounting error on their part, or they could have received one of your previous payments late (blame the U.S. Mail). But . . . .

Sometimes, though, it just doesn't pay to fight "City Hall" and you want to spend $100.00 worth of your time and energy over $1.77?

Just slap a check in an envelope, put a stamp on it, and call it a day.

"Lovy-bear" (how cute)! Yeah you're right. I was told once by a cop that I was a "spit-fire" I guess I can't live that down! Hell, I'm just barely learning how to stand up for my self!! I've always stood up for my daughter, but not myself.

Thank you for your insight.
