I am back! This message is following the original post of "Need help quickly". Here's where I stand now. I have hired an attorney in Iowa, and he has said he can file a case to dismiss. However because this man is claiming we were married I will still have to go through a Divorce hearing. We were never married!! I was 13 when I moved in with him and his parents and shortly after I turned 18 I left him, I never said we were married nor did I sign anything using his last name. My attorney is saying that a divorce and custody/visitation are two totally seperate issues, and that if I go through with the so-called divorce than because the I have Sole physicall custody that the Iowa Courts will make him come to Texas to modify the custody/visitation case. My questions and concerns are
1. Does it matter which state the child resides in when it comes to a Divorce?
2. Is it going to make a difference if I just go along with the divorce to get it out of the Iowa Courts, or will it hurt me later because I agreed?
3. Do I need to contact an attorney in Texas?
My concern is that if I say okay go ahead and do the divorce, that it will back fire on me and something else will come up based on the fact I agreed we were married. If that happens and for some reason I lose my pride and Joy(meaning my daughter to this man, I won't be able to deal with it.... Please help, I need to know what I should and shouldn't go along with. Can anybody help me??????
