Question
what is the definition of infidelity (TX)? My wife and i are going through a divorce and she confessed that she "Kissed" someone (i'm sure it was more) just 2 weeks after we separated (not divorced yet). would i have any chance of winning a custody battle?

Doubtful unless some sexual display in front of the children and was proven to have irreparable damage to the children. Texas judges on the whole from what I have seen, unless the mother is abusive or on drugs, favor joint custody with the mothers having physical custody. Not meaning to burst your bubble with that news but usually you get the opportunity to pay child support and are offered visitation.
