My husband got custody of our 5 yr old son. Because the judge said I was unstable because I live with someone and because when she interview my son seperate from me we both used the word boring and she thinks i told him what to say! I swear I never did. Problem is my son doesn't want to be with his father. Can this decision be fought for discrimination or have i lost all hope?

I am not sure what grounds you could do this as I am not aware of all the facts, but you can always hire an attorney and appeal the decision. Be forewarned, it costs alot to do so.

Yo could take your case to an appelate court. I am not sure as to what you can do against a Judge.

You may want to repost this to the attention of IAAL, or Legal Beagle, or Lawrat.

I have an attorney that wants to appeal it because it was the worst reason she gave he has ever seen. Because I live with someone! I had a home study done and it was great. The judge said I was unstable because the man I live with could throw me out! How would she know? She wouldn't even talk to him. We could get married. What if I was pregnant? My husband could lose his house when the divorce is final then what? What if he had someone move in with him? What if????
My lawyer says it's discrimination.All of his witnesses were mentioned none of mine were. she beleives ever word they said even though I had facts to back up there lies. It doesn't make sense except it's a political decision and she knows his lawyer. I take the court system into my hands a court system who is suppose to have the BEST INTEREST OF A CHILD at heart insted my son is now suffering because he has never been away from me and has a great home here with children to play with, his father has an alchol problem which he admitted to in court. My son is being raised not by his father but by his elderly grandparents in their 80's and a neighbor across the street, With absolutely no kids to interact with. Why is the best interest of my child to have someone else raise him when he has a mother?
His father is doing this over money, and anger towards me. he constantly uses our son against me. I just want to know with her decision do I have a chance with the higher court? How can I get him back? This is so so so wrong. I am dying inside because my biggest worry is my son's mental state.
