DRUG REHAB AND I GOT A JOB MAKING LESS MONEY. MY EX WIFE MAKES MORE THAN ME. I PICK UP MY SON EVERY SAT UNTIL SUN NIGHTS AND I BUY HIM ANYTHING HIS HEART DESIRES. NOW SHE IS TAKING ME TO COURT FOR ARREARS AND WANTS MORE MONEY. I HAVE A NEW FAMILY TO SUPPORT PLUS I SEND MY MOTHER 100.00 A MONTH BECAUSE MY DRUG ADDICT BROTHER SOLD EVERYTHING SHE HAD IN HER HOUSE. HE IS LOCKED UP NOW BUT SHE HAS NOTHING. CAN I DECREASE THE PAYMENT HOW CAN I SHOW THE COURTS FINANCIAL HARDSHIP? CAN SHE COLLECT ARREARS WHILE I WAS IN PRISON? I LIVE IN NEW YORK.

CS does not stop when you are in prison, it is merely suspended.

New family is sometimes irrelevant as you knew about the support to the child prior to the new family.

The money to your mother would unlikely be considered.

If you are earning less money than when the original order was granted, then that might be taken into account if it is seen as the most you can currently earn with your history.

All you can do is go to court and state your case.

OK IF THAT IS THE CASE THEN I WOULD LIKE TO KNOW WHAT DOES THE COURT CONSIDER FINANCIAL HARDSHIP IN NEW YORK?
