keeping her off the 401k

my boyfriend and i live in indiana. his soon to be ex wife was released from prison in last november. my boyfriend works construction and switched jobs right before she went to prison and then we moved here in december so he left that job. he has about 2500$ of 401k built up that she obviously wasn't contributing to from jail. she hasn't mentioned this money yet but the final hearing is coming up soon. we have filed to have the money withdrawn, we have a new 401k and could use the old money to get started at our new home. how can we make sure she can't touch this money? she was not working and going to trial when he got the job we are requesting the money from. thanks.
