marital seperation agreement

I live in California,I have been trying to divorce my husband since June 99. All the paperwork has been filed. I sent him a marital settlement agreement and he hasnt responded to it. That was 4 months ago. How can I divorce him without the signature? How do I file a memorandum that family law case is at issue? Superior Court returned my package to me wanting one or the other. Please help.
