I live in the state of California my 15 year old daughter wants to marry an 18 year old boy of whom she is pregnant by and is now living with how do I petition for them to get married. What are the legal liabilities to myself and this young man.

My response:

California does not have "Parental Consent" marriages. This isn't Arkansas or Kentucky.

The young man can be, and quite frankly should be, reported and arrested for Statutory Rape. He's looking at some serious prison time, and you are exposing yourself to aiding in the delinquency of a minor, subjecting yourself to criminal actions, and potentially having your daughter removed from you by CPS.

Why would YOU want to help them get married ?? Having sex with a child UNDER 16 is a SERIOUS offence... and as IAAL states, YOU can get into SERIOUS trouble if you do not report it..

my advice


My advice to you is if you approve of them getting married you can go to another state that does have parental consenting marriage laws such as Mississippi or Arkansas and sign for the two to be married. If you want to save the father of your daughter's child from Statutory Rape charges that the state of California can and probably will take up on him once the child is born you would go to another state and let the two marry.

My response:

Slight correction, LB. The age of consent in California is 18 years of age, not 16. Like I said, California is not Arkansas or Kentucky.

My response:

It wouldn't matter if they moved. You see, records are everywhere on the pregnancy; school, the doctor's office, and everywhere else. Also, since the "deed" was done in California, the crimes have already been committed. The boy and his mother would be extradited back to California.

I thought that there is a difference in sentence between the girl being 15 and 17. I think I read that if there is more than 3 years between them and she is under 16 that it is a felony instead of a misdem. Maybe it was AR
