Can my sister in law mover out of the state of Mass to Florida. She has gone to court, her husband doesn't pay child support. He is suppose too but doesnt. He makes $600. a week but he doens't care. Now my sister in law wants to make a better life for herself and kids. She said her husband will let her take his two older kids, 18 and 16 but not hte 12 year old. He told her she doens't have any rights. What can she do legal wise to be able to move out. If he doesn't pay child support, and is suppose to, why should he have rights, she should be able to move where she wants to. Anyone have any advise, thanks a caring sister in law, Ladybee

She needs to inform him, in writting, of her decision to move to Florida. He needs to be at least 30 days before the more. Ensure the letter is sent certified etc. He will then have 30 days in which to contest the move if he wants.
