There are a couple of different ways to go about this. One, which is not quite so on the up-and-up, ask to have visitation with the kids. If there is no custody agreement ordered by the court, and your name appears on the birth certificate, you have as much rights to them as she does. Once you obtain them for visitation, contact a lawyer and file for custody, do not take them back. Once you have started custody proceedings the courts should allow you to keep the children until your case is heard in court. My advice first is, to seek the advice of an attorney where you live. The last thing you need is kidnaping charges. But, it would be hard to prove kidnaping if she voluntarily lets the kids come for a visit. A good attorney will be able to tell you all the loop holes to work in your favor.
Second, just get an attorney and file for custody, you'll need proof that the children are living with the grandmother and the mother is not the primary care giver. At which time you will either get physcial custody or you will be given a court ordered visitation schedule.

Another thing, if your name is not on the birth certificates, the you need to petition the courts to acknowledge that you are the father. By the way are you paying child support? If so this will help show your love and concern for these children.
