i would like to know if there is a way to have my granddaughters father give his parental rights away, he has had no contact in her almost 2years of life. Still battling child support as weel, even after it was proven he IS the biological father.

If he has no contact then why force the issue ? What type of court ordered custody does the mother have ? The best thing to do is petition the courts for sole custody (if it is not already) and to change visitation to either none or limited supervised. That way he will need to fight in court to re-establish visitation on his return. It is very difficult for anyone to give away parental rights.

my grandaughter

Why push the issue? The man has no desire to see or have a part of my granddaughters life, why should he get any parental rights? I thought there was some sort of law..if no contact(by choice) in over a year, then they can have their rights taken away. He is recently married an his new wife is expecting. There is no "court order", she is still trying to get support from him. He doesn't want to see her at all. He is in the Navy and I have started a letter to the Commanding Officer, hopefully she will at least get her medical through the military. I do know they do not condone such behavior.

Parental rights are only taken away in extreme circumstances. Is there ANY court orders ?, ie for custody ? If there is no court order then how is she trying to get support from him ?

my granddaughter

She is in the process of getting child support with the help of the DA. He contested the whole thing and asked for a DNA test, which he was 99.67% the father. In December she goes back again for the 20th time. Hopefully at that time she will receive support. The DA said visitaion is a seperate issue.
