my share of injury settlement

My husband and I seperated in july of this year, in may he was in an auto accident where he was rear-ended by a city cop. He was legally stopped. He is now working with a lawyer to get compensation. This is in North carolina. I am now in Michigan. I was told I am entitiled to part of any settlement because we were married and living together at the time of the accident. How do I found out for sure and what steps should I take to ensure I get my share. Thanks Debbie
