name change of minor

I have a 4 yr. old son who has been raised by me and his stepfather since he was 8 months old. The biological father has always payed child support, but hasn't wanted to see my son until just recently, and still doesn't show much interest. My son has my maiden name, and i would like to get it changed to my married name. Do I have to have the biol. fathers consent to change his name? I read that i have to petition a name change, how do i go about doing this? Can I do this without a lawyer?
