Help......I am the full legal cutodial parent of my four year old daughter. In six months I will be married to my fiance - whom my daugher already regards as "daddy". Her biological father has seen her perhaps 10 times in four years and only pays his child support when the enforcment dept garnishes his checks. We have two questions - 1)if we stop the garnishment he will make no effort to pay (he has proven this before) and has made no effort to see her in six month - how long will the financial/emotional abandonment have to be before we have a chance of getting a termination of his rights so we can file for my husband to adopt her? 2) if we are unable to have that done and I were to pass away would custody automatically revert to her biological father or can I, as the full custodial parent, name a guardian to take on the custody in the event of my death? how complicated/expensive are these procedures?? Any info or experiences related to this would be greatly appreciated......thanx. |
