Ok, I am going to trya nd make this long story short, my brother has been seeing this girl in South Carolina for about a year she moved here from NY, they dated lived together and she became pregnant claiming that the child was my brother, through the entire pregnancy there was suspision that the child was not his because extended trips she took to NY, anyway she has a child from a previous relationship when she had the baby she did not allow it to have his (my brother) last name nor did she allow him to sign Birth Certificate claiming because of thier relationship she did not want to do this. Anyway, now she has taken the baby and gone to NY no custody,visitation has been set up he is concerned about the child and wants a paternity test as well as visitation could he take the child when she gets back and still be legal or how can he get his child back??? Please help this girl has been gone for 2months....

It would not be a good idea for him to just take the child. Also you have to know where she is residing as if she does not come back, you will have to progress action in NY. Once you can determine where she is living, file for joint custody with visitation. If she disputes he is the father, a court can order a test. It is unlikely he will get physical custody with the child being so young.
