| The reason for my post is that for the last 7 years and 9 months I have been paying $34.00 a week for childcare to my ex wife, when indeed and admitted there was no childcare. I have written many letters to the local Friend of the Court, and basically have been ignored. I finally put together enough money for an attorney in this matter, and went before a referee. The Other sides council contends that there is some law, that says that they do not have to repay or give credit going back that far, only to the date the motion was made. I am sure that somewhere there is some ruling in matters concerning fraud on the part of the custodial parent that would come into play here. I am looking for court cases where the court ruled that because there was obvious and intentional fraud involved the time frame does not come into play. Please advise as soon as possible. | did you know the money was not being spent on childcare? I have been paying $140. a month for child care and preschool on top of the child support even though my daughter started public school three+ years ago, however, I do this voluntarily to keep the wolf at bay. Its my kid and I can only hope the money is recognized and used properly |

| yes I do know the money was not being spent on child care.. this was an amount over and above the regular support. It is admitted by my ex wife that she quit child care 7 years and 9 months ago. But she didn't think it was her "job" to report that. I know somewhere there is a technicality that says when there is fraud involved that the statute or whatever comes into play an the court system can go back to when the child support stopped. I am looking for case law that will help me with this. Thanks I live in Michigan |

Now if you hadn't paid the money for 7 years you would probably be sitting in jail. For some reason, men always end up with the short end of the stick. Don't give up! There has got to be the right information somewhere. I know I haven't been any help, but I wish you luck. ![]() |

| thanks for your support.. I read with earnest the topic on the other side of the fence.. seems that fathers who do pay.. get stuck paying for the ones that don't .. I would be interested to know how many fathers or ncp's feel the same way I do and how many custodial parents are cheating the system with fony charges.. stop the bleeding I live in Michigan |
