Question

Can ex get an attorney and take me back to court for medical bills I didn't pay back in 1997 and 1998. They are probably about $500 for braces. At the time, I thought I paid half and now she is saying I didn't. I don't know why she waited so long to do this. I don't have $500 just to hand her out of the blue. I have also paid bills that my insurance would have paid that she never filed. Can I bring this up or will he (judge - if she takes me back to court) not care about this? This is in Texas

2 other issues I did not mention. She kept the bills for about a year and sent to me at one time which was a big amount when I got them. Divorce decree says within 10 days of the bill. Also if you have joint custody aren't big medical/dental issues supposed to be discussed before they are done? Just questions I am curious about. I really do pay all the other medical bills, just that she is being such a bi--- about these. Wondering if I would have a chance if she took me back to court. Can anyone advise?

You are responsible for your portiion of the medical bills. If she is not holding up her end of the bargain (not supplying you with receipts the 10 days after) she is not obeying the order. You will have to take her to court to enforce that. (or write her a letter stating that if the problem persists, you will take her to court) Now, that doesn't mean that you get out of paying..you don't. Pay your portion, request that you get bills within 10 days of of the appt. or whatever, If she doesn't abide you take her to court to enforce that issue. Keep copies or proof that you pay her so you dont' end up paying her again..IT HAPPENS! Yes she should consult you with BIG medical decisions, but if she doesn't there isn't a whole lot you can do. Address that situation when you go to court regarding the time frame. Good luck!
