I live in California. I am the noncustodial parent of a 14 year old whom I see one afternoon every other week. If this child commits property damage while with the custodial parent, would I have to pay for any property damage?

My response:

Nope. You're only liable during your "watch". You see, along with the privilege of being the custodial parent, comes the liability of also being responsible for the child's actions while in the custody of the CP. For example, let's say you lived 400 miles away from your child, and your child committs a felony assault and battery upon a school teacher. How could you possibly be responsible if, at the time of the crime, you did not have "posession, custody or control" of the child?

The same rules apply if you only live 4 miles from your child. It only depends upon which parent has posession, custody, or control of the minor at the time of the crime.
