MY FORMER HUSBAND AND I DIVORCED 2 YEARS AGO IN AZ, THE DIVORCE STATES THAT ANY MEDICAL TREATMENTS NOT COVERED BY MY INSURANCE MUST BE SPLIT IN HALF. MY FORMER HUSBAND SAYS HE CANNOT AFFORD THE PAYMENTS FOR OUR DAUGHTER.IS THERE A WAY I CAN RAISE HIS SUPPORT PAYMENTS TO COVER THE ORTHODONTIC TREATMENT?

My response:

Yes. Tell him that you'll pay for the whole enchilada. That you'll accept monthly payments of $100.00 on the 1st of each month, until his half is paid in full. Also, inform him if he's late with any payments, you'll be forced to go to court on an Order to Show Cause and obtain an order to have him pay his whole share and balance.

Tell him, "this is fair, that it's not a matter of you being able to afford the expense; rather, it's a matter of the court orders that YOU SHALL PAY IT". In other words, if he has to take out a bank loan to pay his share, then so be it. Otherwise, if he fails to agree, get into court for the above.
