Question

In my common law wife's divorce papers 6 yrs ago, I was named paramour and she signed an agreement not to have her son in my presence for the fact her ex got sole custody of the little boy and wouldn't let her see her son if she didn't agree to it. How do we go about changing that, if we can, and the fact she and I our common law husband and wife have any influence on the decision.
I am in SC she is in Tenn.

In some ways, it is this sort of post that make me think about becoming a proper attorney.. to try and stop people signing silly agreements...

Was this agreement filed into court ? Is there a proper court ordered visitation schedule in place ?

Basically, go back to court and have it removed. Since you have been together for 6 years then it will add weight to the petition. However, if this was done because you have a violent background or any involvement in drugs then you might not get it changed.

and how does that make you common law husband and wife if you are in different states ?

We lived together in the same state until recently. We are moving and have gotten an apartment in Tenn. until I get things completed here.
