| Our 5 year-old grandaughter's father is in prison in Ohio. She is being raised in a terrible enviornment by her mother in Florida. Her father has indicated he is willing to assign us custody while he is in prison. Since her mother is using the grandaughter as a "meal ticket" she is unwilling to do this. Can the father sue for divorce and custody of the child (which he would temporarily assign to us) while he is in prison? |

| The most direct approach would be the easiest. You should file for custody of your grandchild, yourself. Your son could sign an affidavit of his wishes. Until then, contact the protective services in the county the children are in, if you feel thier well being is in question. Good luck! |
