I am currently residing in Louisiana with my 21 month old daughter. My husband is living in Oklahoma. We have been separated for 3 months now. The first of January I plan on moving to Vancouver, Washington. Where should I do the parenting plan? Should I wait until I get to Washington where I plan on filing for divorce? Does my husband have a say in my move? Please, anyone who can, I would appreciate advice in this matter.
In order to file for the divorce in WA you would need to meet the residency requirements in that state, meaning it could be 6mos before you get your divorce once you move.
I would suggest that since you are both already living apart that you go ahead and file for the divorce there in LA unless there is no rush to get the divorce. In which case wait until you get to WA, wait the 6mos then file for everything there.
Keep in mind though that until there is a seperation/divorce agreement giving one of you primary custody you both have the same rights to the child. |
