my husband is suing for custody , what determines who gets them if both parents are basically fit? I have offered a joint custody arrangement with him but he is arguing about how to split it so i dont think it is an option. I am scared to death. I am fix mom Im a nurse , i work full time though. he has all these witnesses to tell how great he is , i dont have much, my lawyer says he has to prove me unfit is that true? he signed an aggreement in august giving me full custody and him visitation now he is changing his mind he waited until about 4 days before it was final. My lawyer is like , there is nothing to worry about i will win no problem, but i am not so sure. I would like to do a joint custody arrangement but he wont budge, i had proposed a 6 mo split with visitation one weekend a month but he( hubby) says judge wont go for that. i know it would disprupt kids school but how else could you arrange joint custody when the parents live 100 + miles away?

Keep talking with your attorney and read ALL the section on FAMILY LAW at the freeadvice.con homepage.

The court will do what is in the children's best interest and he HAS to prove you unfit to an extent to deny you entirely of custody/visitation.

thanks lawrat for responding. I was scared to death but i think you are saying that I would at least get joint custody , well i know i have to just wait and see what happens but i am not good at being patient
