I have Joint Legal and Physical custody in California, the father has been given the title "primary custodial parent", and has our son through the school year....does this title give him more rights over are child? and what chance do I have in modifying this order,(when there is no signs of abuse or any terrible stuff like that) so that I may be primary custodial parent for the school years? Thank You for your help, -B-

Typically, a chancge in custody results from a change in circumstances. You don't say how old the child is or how long your husband has had him in the current custody arrangement nor do you say why you want this to change. Courts look at what is in the best interest of the child - disrupting a routine he is accustomed to is not necessarily, by with no justification, in the best interest of the child.

My son is now 8 yrs old and he has been with his father the last 3 years, during this time with dad, he began to have behavior problems at school hitting girls and boys ,and was placed on ritilin drug,without any psychological testing or evaluations , and my right to share in this medical decision was completly disregarded by the father,also dad has been frustrating phone contact by only letting me talk to our son 2 times a week, and I have to get a court order to have any time with our son over the holidays, and then some**************I could go on about how our son is slowly getting worse because of dads negativity.....would any of this be substancial enough to ask for a change ? Thank You for your earlier reply-B-
