I am getting ready to speak with an attorney to start divorce proceedings. What are the best ways to go about getting custody, or proving that our kids are better off with me versus my wife?

You will have to file for a divorce, and file for custody of the children. You will need your proof so that the judge can see why you feel the children would be best with you. Be VERY prepared, and if you have solid evidence then you should be alright. What are your reasons anyway?

She is very emotional because of the situation. She is constantly verbally abusing the children, age 5 & 7, swearing at them and actually getting right in their faces and hitting them on the head and shoulders. I want to be very careful that I do not upset them but I also want her to know that it is not their fault and just protect them from anymore abuse. I do not want to go so far as to call the police when it happens but I feel that would be a good way to create a "record". I am keeping a computer log of our daily activities and how she is dealing with them. She continues to go to our beach house on weekends leaving us at home to do our own thing. They boys are beginning to ask questions. I just want to be able to have my facts correct and the proper documentation. That is where I need the advise.

The key ingredient is to document everything! You are on the right track by documenting things, keep doing it. Good luck!
